Vestige Operator Terms of Service

1. Agreement. These Terms govern access to and use of Vestige Operator (the Service). By accepting an invitation, completing an authorized purchase, or using the Service, you agree to these Terms. If you do not agree, do not purchase or use the Service.

2. Eligibility and accounts. The initial Service is available only to invited, signed-in customers who can form a binding agreement. You must provide accurate account information, protect your credentials, and promptly report suspected unauthorized access. You are responsible for activity performed through your account except to the extent caused by our breach of these Terms or applicable law.

3. Service description and human responsibility. Vestige Operator provides continuity, evidence, and control tools for agent-assisted software work. It can preserve and present records, decisions, and authorization evidence, but it does not guarantee that any source, model output, recommendation, receipt, or recorded event is true, complete, secure, causal, or fit for a particular purpose. You remain responsible for reviewing outputs and for every consequential action taken in your environment.

4. Fees, billing, and taxes. The initial approved offer is USD 149.00 for quantity one with no discount. The Checkout page and receipt must state whether the charge is one-time or recurring and control the approved billing cadence. Do not complete Checkout if the displayed amount, cadence, or terms differ. Automatic tax calculation is disabled for the initial opening. You are responsible for taxes that apply to you except where applicable law requires us to collect or remit them. Payment processing is provided by Stripe under its own terms.

5. Cancellation and refunds. You may request cancellation through the authenticated support channel. A cancellation stops future service or renewal as described at Checkout but does not erase amounts already due. Refund requests are reviewed individually and honored where required by applicable law or where an express written refund commitment applies. We will not make a duplicate charge, cancellation, or refund merely to recreate evidence.

6. Acceptable use. You may not use the Service to violate law or another person's rights; introduce malware; evade access controls; probe or disrupt systems without authorization; expose secrets or personal data; impersonate another person; or use the Service to authorize actions that you are not entitled to perform. You may not resell or share an invitation or credential unless we agree in writing.

7. Customer content. You retain ownership of content you submit. You grant us a limited license to host, process, transmit, secure, back up, and display that content only as needed to operate, protect, and support the Service, comply with law, and enforce these Terms. You represent that you have the rights needed to provide the content.

8. Confidentiality and security. We use reasonable administrative, technical, and organizational safeguards appropriate to the Service. No system is perfectly secure. You must not send passwords, private keys, payment credentials, or other secrets through fields that are not expressly designed for them. Security incidents will be handled under the internal response process and applicable law.

9. Availability and changes. The Service may change, be limited, suspended, or contained to protect customers, integrity, or infrastructure. No uptime, response-time, recovery-time, support-time, service-credit, or other service-level commitment applies unless it appears in a separate written agreement signed by both parties.

10. Intellectual property. The Service, software, documentation, branding, and related materials are owned by their respective rights holders. Except for the limited right to use the Service under these Terms, no rights are transferred to you. Feedback may be used without restriction or payment, provided it does not identify you or disclose your confidential information without permission.

11. Third-party services. The Service depends on third-party infrastructure and payment providers. Their availability and terms may affect the Service. We are not responsible for a third party's independent acts, but we remain responsible for our obligations under applicable law and these Terms.

12. Suspension and termination. We may suspend or terminate access to address security, integrity, payment, legal, or abuse risk. You may stop using the Service and request cancellation. Sections that by their nature should survive termination, including payment obligations, ownership, disclaimers, limitations, and dispute provisions, remain effective.

13. Disclaimers. To the maximum extent permitted by applicable law, the Service is provided as available and without implied warranties of merchantability, fitness for a particular purpose, noninfringement, or uninterrupted or error-free operation. Nothing in these Terms excludes a warranty or right that cannot lawfully be excluded.

14. Limitation of liability. To the maximum extent permitted by applicable law, neither party is liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, goodwill, or data, arising from the Service. Our aggregate liability arising from the Service will not exceed the amount you paid for the Service during the twelve months before the event giving rise to the claim. This limitation does not apply where applicable law prohibits it or to liability that cannot lawfully be limited.

15. Changes to these Terms. We may update these Terms for legal, security, operational, or product reasons. Material changes will be presented through the Service or the verified customer communication channel before they take effect when required by law. Continued use after an effective update constitutes acceptance where permitted by law.

16. Contact. Use the authenticated Vestige Operator support surface shown in your account for support, privacy, security, cancellation, and legal notices. The opening is not approved until that destination has been verified as monitored.
